    SECTION 01450

    UNCOVERING AND CORRECTION OF WORK

   PART 1 - GENERAL

   1.01 GENERAL

    A. The requirements of this section are in addition to the requirements of Section 009, Fixed Price Construction.

    B. The requirements of Section 01460 (Cutting and Patching) form a part of this section and must be complied with.

    1.02 UNCOVERING OF WORK

    A. If the Contract Documents, laws, ordinances, rules, regulations or orders of any Public Authority have jurisdiction require any portion of the Work to be uncovered for inspection, the Contractor shall give the Engineer timely notice of its readiness so that the Engineer may observe such inspections.

    1. If such Work is in accordance with Contract Documents, costs of uncovering and replacement shall, by appropriate Change Order, be charged to the Owner.

    2. If such Work is not in accordance with Contract Documents, the Contractor shall pay such costs unless the condition was caused by the Owner or a separate contractor in which event the Owner shall be responsible for payment of such costs.

    B. If a portion of the Work is covered contrary to the Engineer’s request or to requirements specifically expressed in the Contract Documents, it must, if required in writing by the Engineer, be uncovered for the Engineer’s observation and be replaced at the Contractor’s expense without change in the Contract Time.

    C. If a portion of the Work has been covered which the Engineer has not specifically requested to observe prior to its being covered, the Engineer may request to see such Work and it shall be uncovered by the Contractor.

    1. If such Work is in accordance with Contract Documents, costs of uncovering and replacement shall, by appropriate Change Order, be charged to the Owner.

    2. If such Work is not in accordance with Contractor Documents, the Contractor shall pay such costs unless the condition was caused by the Owner or a separate contractor in which event the Owner shall be responsible for payment of such costs.

   1.03 CORRECTION OF WORK

    A. The Contractor shall promptly correct the Work rejected by the Engineer and/or the Public Authority, whether observed before or after Substantial Completion and whether or not fabricated, installed or completed.

    B. The quality of materials and workmanship used in restoring this work shall be in full compliance with the requirements of the Contract Documents.
