PROTECTION OF PROPERTY AND THE ENVIRONMENT
PART 1 - GENERAL
1.01 SCOPE OF THIS SECTION:
This Section provides specific information and defines general and specific requirements of the Contractor regarding protection of property and the environment at and around the project site.
1.02 RESPONSIBILITY FOR PROTECTION:
The Contractor shall do all work necessary and be solely and completely responsible for protecting all public property, the property of the Owner, and the environment at and around the site from physical damage or other injurious conditions that could result from the work to be performed under this Contract.
1.03 PROTECTION OF PUBLIC PROPERTY:
A. The Contractor shall employ such means and methods as necessary to adequately protect public property and property of the Owner and that of other Contractors against damage. In the event of damage to such property, the Contractor shall, at his own expense, immediately restore the property to a condition equal to its original condition and to the satisfaction of the Owner and the owner of said property.
B. When hauling materials on or across roadways, take precautions to prevent spillage of material or debris from haul vehicles. If such spills should occur, promptly clean them. This requirement also applies to mud and dirt resulting from construction traffic.
C. Take precautions to avoid staining service and public roadways by tire marks from trucks and equipment. If stains from tires or spillage of material should occur, clean them as soon as practicable before the end of the work day to the Engineers satisfaction.
1.04 PROTECTION OF WATERWAYS:
A. The Contractor shall observe the rules and regulations of the State and agencies of the United States Government prohibiting the pollution of rivers and streams by the dumping of any refuse, rubbish, or debris therein.
B. Discharge of all fluids to the environment will be governed by applicable Federal, State, and local regulations.
C. Handling, Storage and disposal of all hazardous and/or solid wastes will be as mandated by Federal, State and local regulations (see Section 01016 - Safety During Construction).
1.05 PROTECTION OF AIR QUALITY:
A. The air pollution likely to occur due to construction operations shall be properly controlled in accordance with regulations of authorities having jurisdiction.
B. No trash burning on project site will be allowed; dispose of trash off the site in accordance with local regulations.
C. If temporary heating devices are necessary for protection of the work, such devices shall be of an approved type that will minimize pollution of the air.
D. All dust, fumes or vapors generated as the result of lead-paint removal activities will be controlled as described herein and will be governed by all applicable Federal, State and local regulations.
1.06 CONSTRUCTION NOISE CONTROL:
A. The Contractor shall conduct all his work, use appropriate construction methods and equipment, and furnish and install acoustical barriers, all as necessary so that no noise emanating from the construction process or any related tool or item, will exceed legal noise levels.
B. Air compressing units shall be equipped with silencers and the exhaust of all gasoline motors or other power shall be provided with mufflers.
C. In the vicinity of hospitals and schools, special care shall be used to avoid noise or other nuisances. The Contractor shall strictly observe all local regulations and ordinances covering noise control.
1.07 ACCESS TO PUBLIC SERVICES:
Neither the materials excavated nor the materials used in the construction of the work shall be so placed as to prevent free access to all fire hydrants, valves, manholes, etc.
